Paying your salary: conditions

The LG will pay your salary, pension, holiday remuneration, and other costs if:

  • Your employer is bankrupt or the company has closed down because of insolvency.
  • You are a wage earner, i.e. you cannot be a co-owner of the company or part of senior management.

Please note that you will not receive any reimbursement until the bankruptcy has been fully confirmed. The fact that a bankruptcy petition has been filed is not in itself sufficient.

LG does not normally cover you in the following circumstances:

  • In cases of forced composition, i.e. when an agreement has been made about the payment of debts
  • If the company is taken over or sold to a third party.

If the conditions for coverage are not fulfilled

If your employer is not covered by the LG law, we cannot make any payments to you.

Holiday during the notice period

If you have holiday time left over from previous years and you are not required to work, the LG is entitled to set the holiday dates to occur during the notice period. The amount of holiday the LG is entitled to set during the notice period depends on the Danish Holidays Act's rules of notification.

More information is available here: Holiday

Do I have to apply for a new job during the notice period in order to obtain compensation?

Yes. If you are not required to work by the employer, it is your duty to limit your losses during the notice period.
